New York State’s Enhanced Estate Recovery — Are YOU Protected?

After many years of speculation and debate, the New York State Legislature passed the enhanced Medicaid estate recovery regulations, effective September 8, 2011. The legislative objective of this new regulation is to increase the amount of Medicaid recoveries by expanding the definition of an “estate” to include assets that pass outside of the Medicaid recipient’s probate estate.
